General Terms and Conditions (GTC) of Pix-Shop

1. Scope and Definitions

These General Terms and Conditions (GTC) govern all contracts concluded via our online shop between Pix-Shop and consumers or entrepreneurs.

  • A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.
  • Entrepreneurs are natural or legal persons or partnerships with legal capacity who, when concluding a contract, act in the exercise of their commercial or self-employed professional activity.

These GTC also apply to future business relationships with entrepreneurs, even without a renewed express agreement. Conflicting or deviating terms and conditions of the contractual partner do not apply unless we expressly agree to their validity.

2. Payment Methods and Processing

The following payment options are available in our online shop:

  • PayPal (incl. credit card, direct debit, invoice, Express & Plus)
    If you select PayPal, you will be redirected to the PayPal platform. Registration may be required.Credit card payment via PayPal also works without a PayPal account.For invoice purchases via PayPal, a credit check is performed; the claim is assigned to PayPal.

  • Sofortüberweisung (Klarna Sofort)
    After completing the order, you will be redirected to Klarna's subsidiary Sofort GmbH, where you can complete the payment using online banking (PIN/TAN procedure).
  • Amazon Pay
    If you select this option, you will be redirected to Amazon. After selecting the delivery address and payment method, you will return to the order confirmation.

Please note: The terms and data protection regulations of the respective payment service providers apply in addition to our General Terms and Conditions.

3. Conclusion of Contract

The presentation of the products in the shop constitutes a binding offer of sale.

A purchase agreement is concluded as soon as you submit your order by clicking the "Buy Now" button. Before doing so, you can review and adjust all your entries. After submission, you will receive an order confirmation by email, which documents the contract.

4. Vouchers and Discounts

Promotional Vouchers

  • Issued only as part of promotional campaigns, not available for purchase.
  • Usable once per order and per customer, not combinable with other promotional vouchers.
  • May be subject to a minimum order value.
  • No cash payout or interest.
  • In case of full or partial returns, an additional charge may apply if the minimum order value is no longer met.

Value Vouchers

  • Issued at our discretion and are personalized.
  • Not transferable or available for purchase.
  • Remaining balances are available for future orders.

Product Vouchers

  • Entitle the holder to a specific product.
  • Also issued at our discretion, not transferable or for sale.
  • Redemption is processed via the customer account.

Gift Vouchers

  • Available for purchase, with a freely selectable amount.
  • Validity: 3 years (Germany), 5 years (Austria & Switzerland).
  • Redeemable across multiple orders, remaining credit is retained.

Discount Codes

  • Grant discounts on specific products, quantities, orders, or shipping.
  • Redeemable only once during the ordering process.
  • Not combinable with other discount codes, but combinable with vouchers.

5. Promotional Gifts

Gifts received during promotions are tied to a specific minimum order value. If this value is undercut by returns, the gift must be returned.

6. Retention of Title

The delivered goods remain our property until full payment has been made.
For entrepreneurs: Ownership remains until all claims from the current business relationship have been fully settled. Claims from resales will be assigned to us up to the outstanding amount.

7. Contract Language & Storage

The contract language is German.
The complete contract text, including order data, is stored by us but is not permanently accessible online. You will receive an order confirmation by email with all relevant information and the terms and conditions.

8. Delivery & Shipping Costs

All prices in the shop are exclusive of shipping costs, which are shown in the shopping cart and in the product description.
Shipping is exclusively available - self-collection is not possible.

9. Warranty & Guarantees

The statutory defect liability law applies.
For used goods sold to consumers: Claims expire 12 months after receipt of the goods.
For businesses:

  • New goods: Warranty period is 1 year.
  • Used items: Warranty excluded.
  • Recourse claims (Section 445a BGB) remain unaffected.

In case of defects, we are entitled either to repair or to deliver a replacement.

Exceptions to limitations:

  • Damage to life, limb, health
  • Intent or gross negligence
  • Malice
  • Warranty promises
  • Product Liability Act

10. Liability

We are liable without limitation for damages in cases of:

  • Injury to life, limb, or health
  • Intent or gross negligence
  • Breach of essential contractual obligations (cardinal obligations – only up to the amount of foreseeable damage)

Further claims for damages are excluded, as far as legally permissible.

11. Transport Damages

Please report obvious shipping damage directly to the delivery person and inform us as soon as possible. Your statutory rights remain unaffected.

12. Online Dispute Resolution / Conciliation

The EU Commission provides a platform for online dispute resolution:

13. Final Provisions

For entrepreneurs, public law entities, or special public funds, our company's registered office is the exclusive place of jurisdiction for all disputes.
